JUSTICE ROLE IN IMPROVING THE EASE OF DOING BUSINESS IN INDONESIA

Jakarta-PR. As a mandatory of Article 4 Law Number 39 of 2009 concerning Judge Authority, Court will participate actively to solve the barriers and obstacles to reach simple, fast and inexpensive justice. This achievement directly or indirect will help public to seek justice, include for businessmen who effort to complete the case.

This is commitment, as stated Chief Justice of Supreme Court of Republic of Indonesia in Seminar of Justice Role in Improving the Ease of Doing Business in Indonesia on march 7 2016 in Jakarta. For Hatta Ali, this commitment is not negotiable because this was mandated by Supreme Court Law itself.

This commitment was showed by Supreme Court of Republic of Indonesia trough hard work in justice reform structurally and substantially, to improve the public trust and to participate in law reform in Indonesia. Participation in improving the easy in enterprise, a number of policy has issued, consisting:

  1. Circular of Supreme Court of Republic of Indonesia Number 2 of 2014, which minimize the time line in case completing in First Level Court and the Appeal Court, from 6 months to 5 months in first level court, and 3 months in Appeal Court.
  2. Decision Letter of Chief Justice of Supreme Court of Republic of Indonesia number 214 of 2014, especially manages the time line to complete cases in cassation level which is shortened to 250 days only or 8 months (before it was 1 year), that shortened 9 ways.
  3. Regulation of Supreme Court of Republic of Indonesia number 2 of 2015 concerning the ways to complete small claim court, that point is giving solution for civil disputes under 200 million in short period and considerably simplified proceeding.
  4. Regulation of Supreme Court of Republic of Indonesia number 1 of 2016 concerning Mediation that complete mediation law frame so dispute expected to complete in short period, inexpensive, and good relation of the parties maintained. Thereby the business activities can continue well.
  5. Gradual moderation of the court, include moderation of Supreme Court of Republic Indonesia, which covered implementation of decision database since 2007, online case information since 2008, electronic filling for cassation and judicial review since 2014, and for first court level and high court, that justice seekers can monitor session schedule and the decision.

Known that enhancement of ease of doing business) is strategy development direction that contained in National Medium Term Development Plan 2015-2020. In 2016, The Government has planned the improvement of ease of doing business ranks in Indonesia from 109 to 40 in Ease Doing Business Survey. This way is to develop small and medium enterprises in Indonesia and also to support economy development trough investment.

The seminar was held by Supreme Court of Republic Indonesia was media to establish dialogue, idea and experience exchange among stakeholders, considering the wide scope of ease of doing business issues medium term cooperation and coordination among the parties.

The seminar attended by 150 participants consisting Leaderships of Supreme Court, Honorable Justices, Officials of Supreme Court, Head of The First Court in Jabodetabek, Surabaya and Bandung, Senior Judge from each court, legal practitioners, business practitioners, International Organization delegation, donor country, and Indonesia Government.

Specifically Supreme Court of Republic Indonesia invites Chief Justice Federal Court of Australia, Honorable Chief Justice James Allsop Ao, to share idea and experience that related to Australia Federal Court role in effort to support the ease of doing business, more than one decade between Federal Court of Australia and Supreme Court of Republic Indonesia cooperated and discussed kind of issues, particularly in justice reform initiative.

The seminar was held well through cooperation between Supreme Court of Republic Indonesia and Investment Coordinating Board, and also support from Australia Indonesia Partnership for Justice (AIPJ) and Australia Indonesia Partnership for Economic Growth (AIPEG). (PR/Azh/Rs)
