ALL JUSTICES HAVE RIGHT TO CHOOSE AND TO BE CHOSEN AS CHIEF JUSTICE OF SUPREME COURT
Jakarta – Public Relation: Supreme Court of Republic of Indonesia held a plenary session especially for election of Chief Justice of the Supreme Court for the 2020 – 2025 Period on Monday, April 6th, 2020 at Kusumah Atmaja room, Jakarta.
The election concerns with health protocol followed by all justices which is 47 justices.
In attendance list that collected by election committee, reported that justices attending the election are 47 people. This is signed that there is no justice absent in this election. According to Act No 14 year 1985 on Supreme Court as amended and added with Act number 5 year 2004, and the last amended Act Number 3 year 2009 that decides Chief Justice and Vice Chief Justice of Supreme Court is chosen by and from justices. So that justices have right to choose and to be chosen.
Furthermore, when the election session will be begun, Chief Justice of Supreme Court, Prof. Dr. M. Hatta Ali, SH., MH, states that May, 1st 2020 is due for his retirement, so that he decides to do not take his right in the election. Even tough, Hatta Ali states that he definitely supports all election process and also support anyone who will be chosen later. Due to this condition, the amount of chooser is 46.
In the election result, there are six justices who garner the vote, the names are below:
- Dr. H.M. Syarifuddin, SH., MH. got 22 votes
- Dr. H. Andi Samsan Nganro, SH., MH got 14 votes
- Dr. H. Sunarto, SH., MH, got 5 votes
- Dr. Amran Suadi, garnered 1 vote
- Prof. Dr. Supandi, SH., M.Hum, got 1 vote
- Dr. H. Suhadi, SH., MH, got 1 vote
Besides, there are two illegal ballots, so the amount of ballots is completely 46. Chief Justice of Supreme Court says that the amount is still not quorum enough, so he decides to hold the second round of election. Different with the first round, where all justices have right to choose and to be chosen, in second round there will be only two candidates, both are who get the highest votes, namely M.
